Conditions for Listing Vehicles for Sale

Please read the Conditions carefully as they will govern the provision of listing the Seller's vehicle for sale on any platform or media owned or operated by A H Spares Ltd

1. A H SPARES LTD'S CONDITIONS FOR LISTING THE SELLER'S ADVERT

i. These conditions apply to any advert for the sale of any vehicle by the Seller on any platform or media owned or operated by A H Spares Ltd.

ii. By submitting and placing an advert on A H Spares Ltd, the Seller is deemed to have accepted these conditions.

iii. Each advert supplied by the Seller and approved by A H Spares is subject to these conditions.

iv. The Seller accepts that A H Spares Ltd is only listing the vehicle for sale on any platform or media owned or operated by A H Spares Ltd and that A H Spares Ltd will not engage directly with the buyer on behalf of the Seller or engage directly with the Seller on behalf of the Buyer.

v. The Seller grants A H Spares Ltd permission to list the Seller's contact telephone number and/or email address on the Seller's advert.

2. SUBMITTING AND PLACING AN ADVERT

i. By submitting the details and photo(s) of the advert, the Seller declares that the details and photo(s) submitted is/are accurate to the best of the Seller's knowledge.

ii. By submitting the details and photo(s) of the advert, the Seller declares that they are the legal owner of the vehicle in the advert or a nominated representative authorised by the Seller to submit the advert on the Seller's behalf.

iii. The Seller accepts full responsibility for the accuracy of the information about the vehicle listed on any platform or media owned by A H Spares Ltd.

iv. The Seller accepts full responsibility for the accuracy of the photo(s) of the vehicle listed on any platform or media owned by A H Spares Ltd and declare the photo(s) to be a true representation of the vehicle being listed for sale on any platform or media owned by A H Spares Ltd.

v. If the Seller's advert submission is approved by A H Spares Ltd, A H Spares Ltd will aim to publish the Seller's advert on any platform or media owned or operated by A H Spares Ltd by the next working day. This timescale is not guaranteed and is subject to the discretion of A H Spares Ltd.

vi. Before submitting the advert, the Seller should ensure all the details about the vehicle to be sold are correct and all spelling is in English and is correct. The Seller accepts the details they provide will be used verbatim on the listed advert on any platform or media owned or operated by A H Spares Ltd. A H Spares Ltd may make minor corrections to any spelling mistakes at their discretion.

vii. If any corrections or amendments are to be made to the Seller's listed advert, it is the Seller's responsibility to ensure any corrections and amendments are communicated clearly to A H Spares Ltd.

viii. A H Spares Ltd reserves the right to approveor reject advert submissions at their own discretion.

ix. It is the Seller's responsibility to communicate to A H Spares Ltd as soon as the Seller's car is sold or no longer on the market either in writing.

x. The Seller's advert shall remain on the listing on any platform or media owned or operated by A H Spares Ltd for a period of no less than 3 months unless otherwise advised by the Seller in Condition 2.9.

3. ADVERT CONTENT GUIDELINES

i. Each advert may only feature one vehicle. If the Seller wants to list more than one vehicle, the Seller must make a separate submission.

ii. The Seller must submit at least one photo and may submit more than one photo of the vehicle to be sold. However, A H Spares Ltd reserves the right to edit or reject any photo submitted by the Seller.

iii. The Seller is solely responsible for uploading the photo(s) of the vehicle to be used in the advert listing on any platform or media owned or operated by A H Spares Ltd.

iv. Photos submitted for the advert listing must conform to the following requirements:

• Photos submitted must show only one vehicle clearly within the frame and not cropped.
• Photos submitted must not contain: nudity, profanity, pornography, drug use, violence, attacks on individuals or groups (including sexist, racist, defamatory or homophobic material), obscene material, copyrighted material including music or radio audio, material that could be considered dangerous or encourage others to be dangerous.
• Photos submitted for the listing must not show any individuals who can be identified.

iv. Any photos that do not conform to the requirements in Condition 3.2 will be rejected.

v. A H Spares Ltd reserves the right to crop and/or resize the Seller's photo(s).

4. INTELLECTUAL PROPERTY RIGHTS

i. The Seller grants A H Spares Ltd without condition non-exclusive, irrevocable, perpetual and royalty free licence to use any photos the Seller provides and details of the vehicle the Seller submits for the purposes of advertising their vehicle, for marketing purposes.

ii. The Seller confirms that neither the Seller nor any other person will assert at any time any moral rights in or relating to photos and vehicle details supplied by the Seller.

5. LIABILITY

i. The Seller declares that A H Spares Ltd shall under no circumstances be liable for any loss, damage, theft destruction, personal injury or death as a direct or indirect result of the information and/or photos supplied by the Seller for the purposes of advertising the Seller's vehicle.

ii. The Seller declares that A H Spares Ltd shall under no circumstances be liable or responsible for selling the Seller's vehicle at any stage of the transaction.

iii. The Seller declares that they are wholly responsible for questions and/or complaints relating to the Seller's vehicle in the Seller's advert on any platform or media owned or operated by A H Spares Ltd.

6. GENERAL

i. The Conditions apply between the Seller and A H Spares Ltd. No other person, party or company shall have any right to enforce them.

ii. These Conditions are governed under English law and any disputes arising out of these conditions will be governed by English Law.
